
The Rajasthan High Court has quashed an FIR for food adulteration, ruling that police have no authority to investigate offences under the Food Safety & Standards Act, 2006.
Only Food Safety Officers can proceed, given the Act’s overriding effect through Sections 59(i) and 89.
Justice Anoop Kumar Dhand relied on Supreme Court precedents to hold that IPC Sections 272 & 273 cannot apply when the FSS Act specifically governs the offence.
The FIR was set aside, but Food Safety Authorities are free to act as per law.
