
The Rajasthan High Court has refused to quash an FIR for kidnapping and theft, stressing that allowing settlements in non-compoundable offenses would set a dangerous precedent and encourage offenders.
The accused had allegedly abducted the complainant at gunpoint, assaulted him, and robbed his gold chain.
Justice Farjand Ali observed that Sections 365 and 382 IPC involve public safety and cannot be compromised privately. The court emphasized that criminal intent and the gravity of the crime necessitate a judicial process.
The court stressed upon quashing of such serious offences would undermine criminal law and justice, thereby dismissing the plea.
