Rajasthan High Court: Police Surveillance Booth Outside Home Violates Right to Privacy Under Article 21

The Rajasthan High Court has declared that placing a police diary booth (or surveillance point) directly outside an individual’s residence violates the right to life and privacy under Article 21 of the Constitution.

The court held that such intrusive monitoring, without due cause or legal sanction, amounts to harassment and mental torture.

It cited Section 152 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), which requires law enforcement to respect personal liberty and avoid arbitrary actions. 

The Court appointed a Court Commissioner, directing him to evaluate the issue. The matter is now listed on September 8.
