
The Rajasthan High Court set aside a 27-year-old conviction under the Essential Commodities Act, holding that gas regulators are not “essential commodities” unless specifically notified by law.
The Court ruled that mere possession of gas regulators without proof that they were notified as essential commodities at the relevant time cannot sustain a criminal prosecution.
It observed that when the essential nature of the item itself is not established, the quantity recovered becomes irrelevant.
Finding the conviction legally unsustainable, the Court allowed the appeal and set aside the judgment.
