Rajasthan High Court Dismisses Plea Against Appointment of Sitting SC Judge's Son as AAG

The Rajasthan High Court dismissed a plea challenging Padmesh Mishra’s appointment as Additional Advocate General (AAG), affirming the State’s authority to modify eligibility criteria. 

The court ruled that AAG is not a public post, and the State can amend policies unless proven arbitrary. The petitioner alleged Mishra lacked the required experience and was appointed unfairly.

However, the court held that the amendment introducing Clause 14.8, granting discretion in appointments, was a valid executive decision.

It found no evidence of arbitrariness or bias, stating policy guidelines are not legally binding.

Consequently, the petition was rejected, upholding Mishra’s appointment as AAG.
