Right to Reasonable Accommodation is a Fundamental Right : SC Allows Admission for Candidate with Disability

The Supreme Court has held that reasonable accommodation for persons with disabilities is a fundamental right under Articles 14, 16, and 21, not an act of charity.

The Court made this observation while directing AIIMS Delhi to admit Kabir Paharia, a Scheduled Caste candidate with 68% locomotor disability, who had secured rank 176 in the SC PwBD category in NEET-UG 2024.

He was earlier deemed ineligible by VMMC, Safdarjung Hospital, citing inability to wear sterilised gloves due to hand and foot disabilities.

The Court directed the National Medical College to revise its guidelines to ensure no deserving candidate is treated unfairly before NEET-UG 2025-26 counselling starts.
