Supreme Court Allows Voter List Update in Bihar, Says No Stay on EC’s Constitutional Duty

The Supreme Court has refused to stay the Election Commission’s Special Intensive Revision (SIR) of Bihar’s electoral rolls, allowing the process to continue. 

Petitioners, including ADR, PUCL, MPs Mahua Moitra and Manoj Jha, called the EC’s June 24 order arbitrary and discriminatory, claiming it violates Articles 14, 19, 21, 325, and 326 of the Constitution and the Representation of People Act, 1950.

The Court directed the EC to consider Aadhaar, Voter ID, and ration cards as valid documents, but clarified that it’s not mandatory for their inclusion. The court noted concerns over the possible exclusion of poor and migrant voters.

The matter will be heard again on July 28.
