SC Clarifies UGC/AICTE Retirement Age Rule Does Not Apply to Administrative Role

  • Case Name: P.J. Dharmaraj v. Church of South India & Ors. [2024 INSC 938]
  • Judge(s): Justice Vikram Nath & Justice Prasanna B. Varale
  • Advocate(s): Gopal Sankaranarayanan; Abhijeet Sinha

The Supreme Court has dismissed an appeal filed by the former Director P.J. Dharmaraj of CSIIT, who challenged his retirement at age 60 years.

The Court clarified that the AICTE and UGC regulations, which set the retirement age at 65, apply exclusively to teaching staff, not to administrative roles. Since the retirement age for teaching staff at CSIIT is 60, in line with the rules of JNTU, the Court upheld the institution's decision.

The Director's appeal was rejected, reinforcing that the retirement age for administrative positions remains distinct from that for faculty under these specific guidelines.
