The Supreme Court refused to entertain a PIL seeking to extend the PoSH Act, 2013, to political parties. A Bench of CJI BR Gavai and Justice K Vinod Chandran said the matter squarely falls within Parliament’s domain.
The petition, filed by Advocate Yogamaya MG, flagged non-compliance with the Act, especially the absence of Internal Complaints Committees in political parties.
The Court noted that the Kerala High Court 2021 judgment, holding that the political parties were not required to Internal Complaints Committee under the POSH Act can be challenged through an appeal.
The plea was accordingly withdrawn, with liberty to pursue other legal remedies.
