State Employees on Deputation Not Eligible for Pension Under Central Civil Service: Supreme Court

The Supreme Court held that a state government employee on deputation to a central government post cannot receive a pension under the Central Civil Services (Pension) Rules, 1972.

Phani Bhusan Kundu, a West Bengal employee deputed as Animal Husbandry Commissioner claimed central pension benefits after retiring in 1992. 

The CAT (Central Administrative Tribunal) and Calcutta High Court had supported his claim.

However, the SC clarified that deputation is temporary and does not provide absorption or permanent status in the central government.

Kundu’s pension will continue under the West Bengal Pension Rules, 1971, as he remained a state government employee.
