SC halts Sambhal Mosque Survey Proceedings

  • Case Name: Committee of Management, Shahi Jama Masjid, Sambhal v. Hari Shankar Jain & ors
  • Judge(s): CJI Sanjiv Khanna & Justice Sanjay Kumar

A case claimed the Shahi Jama Masjid in Chandausi was built by Mughal emperor Babar in 1526 after demolishing a Hindu temple.

The Sambhal trial court issued an ex-parte order for a mosque survey by an advocate commissioner, which led to violence.

The petitioner approached the SC and argued that the suit was barred by the Places of Worship Act and the trial court decision was unfair. The petitioner stated the mosque is an ancient monument protected by ASI.

The SC temporarily halted proceedings, orderd the survey report to remain sealed, and barred further steps without High Court permission, pausing trial court actions until January 8.
