Supreme Court Rules Possession Suits on Void Sale Deeds Fall Under 12-Year Limitation

The Supreme Court has held that a suit for seeking possession of immovable property on the ground that the sale deed is void is governed by a 12-year limitation period under Article 65 and not the 3-year period under Article 59 of the Limitation Act, 1963.

The ruling came in a dispute over agricultural land in Haryana, where the Court noted that property owners can recover possession if a deed is void, but they must file within 12 years of knowing that another person has taken adverse possession.
