Father Jailed for Life for Raping Minor Daughter, IPC Punishment Will Prevail : Supreme Court

The Supreme Court recently ruled that when an offender is convicted under both the POCSO Act and IPC, the harsher punishment must apply as per Section 42 of the POCSO Act.

The offender was convicted of raping his minor daughter under Sections 376(2)(f) and 376(2)(i) of IPC and Sections 3 & Section 4 of the POCSO Act. The trial court sentenced him to life imprisonment, which the HC modified to life imprisonment for the remainder of his natural life.

Further, the Supreme Court upheld the conviction but removed the "remainder of natural life" clause and ordered the appellant to pay the victim a ₹5,00,000 fine.
