Supreme Court: Legislative Decisions Not Immune from Judicial Review

The Supreme Court has ruled that while "proceedings in the Legislature" are protected under Article 212(1) of the Constitution, "legislative decisions" are subject to judicial review.

The Court held that the Bihar Legislative Council’s Ethics Committee’s decision to expel RJD MLC Sunil Kumar Singh was administrative and could be legally challenged.

Singh was expelled for alleged derogatory remarks against Bihar CM Nitish Kumar.

The Legislative Council claimed immunity, citing Article 212(1). However, the Court clarified that only procedural irregularities in legislative proceedings are shielded.
