SC Makes Ruling in DND Flyway Toll Case, Strikes Unfair Terms Against NTBCL

The SC dismissed the appeal of NOIDA Toll Bridge Company Ltd. (NTBCL), challenging the Allahabad High Court’s decision that ruled against the continued toll collection on the Delhi-NOIDA Direct Flyway (DND Flyway).

The Court held that the Concession Agreement between NTBCL and NOIDA, which allowed toll collection, was unfair, unreasonable and opposed to public policy, as NTBCL had already recovered its project costs. 

The Court invoked the Doctrine of Severability, striking down certain provisions of the agreement as violative of Article 14 of the Constitution.

The judgment emphasizes the protection of public interest and prevents private profiteering from public infrastructure.
