The Supreme Court has ruled that while employees do not possess the right to promotion but they are entitled to be considered for promotion unless disqualified.
This decision came in the case of a Tamil Nadu police constable who was denied promotion to sub-inspector in 2019 due to a 2005 disciplinary punishment, which had been set aside in 2009. Hence, he was not even considered for the promotion.
The Court noted an unjust denial based on a punishment that no longer stood and ordered his promotion consideration with consequential benefits.
The court directed authorities to consider his promotion from 2019 and grant consequential benefits.
