Supreme Court Considers Plea to Enforce Fundamental Duties, Seeks Centre’s Response

The Supreme Court is hearing a plea to make the Fundamental Duties legally enforceable.

Advocate Durga Dutt requested the Court to direct the Centre to give incentives for following these duties and to form a committee to review them. 

However, Justice Sanjiv Khanna noted that courts cannot compel Parliament to legislate on the issue and that many laws already reflect these duties. Attorney General R Venkataramani said Fundamental Duties should be nurtured through awareness, not forced by law.

The Court has given the Centre six weeks to list relevant laws and will resume the hearing after November 2024. No interim relief was granted.
