The Supreme Court has ruled that a retired government employee cannot be denied a pension if their absence was marked as extraordinary leave.
The Court held that once an employee’s service is regularized, it cannot be treated as a "break in service" to reject pension benefits.
Pension denial must follow clear rules, not arbitrary decisions.
In this case, a government employee was prevented from signing the attendance register, leading to her absence. Without any inquiry, authorities denied her pension.
The Court ruled that the authorities failed to prove unauthorized absence and ordered the authorities to finalize her pension within three months.
