Supreme Court Stays Arrest of Advocate Booked Under Gangsters Act for Drafting Sale Deeds

The Supreme Court granted interim protection from arrest to Advocate Sandeep Kumar, booked under Sections 2 and 3 of the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986, for being a deed-writer for certain sale deeds.

A special leave petition challenged the Allahabad High Court’s refusal to quash the FIR. The petitioner, represented by Advocate Anurag Ojha, argued that he only rendered legal assistance as a deed-writer.

The court observed that invoking the Gangsters Act against a practising advocate for professional services was unjustified, and the arrest was stayed, directing him to cooperate with the investigation.
