Supreme Court Declares Right to Housing a Fundamental Right Under Article 21

The Supreme Court held that the right to housing is a fundamental right under Article 21 of the Constitution.

The Court urged the Union Government to establish a revival fund to help stress-ridden real estate projects, aiming to protect bona fide homebuyers and prevent viable projects from being liquidated. 

The Court emphasised that measures should ensure financing and support for such stalled projects, so that homebuyers aren’t left stranded due to project defaults.
