Supreme Court Refuses to Order Anil Ambani’s Arrest, Cites Judicial Restraint

The Supreme Court has declined to order the arrest of industrialist Anil Ambani in a bank fraud case involving Reliance Communications.

The Bench of CJI Surya Kant and Justice Joymalya Bagchi emphasized that arrests should not be used to "sensationalize" matters or act as a "tool of last resort" unless requested by investigators.

Referencing the Antil judgment, the Court noted that custodial interrogation is unnecessary if witnesses are not being tampered with.

While Advocate Prashant Bhushan labeled Ambani the "kingpin," the Bench warned against the "devastating collateral damage" monitored investigations can cause to listed companies and public utilities.
