SC Rejects Claim For Promotion In NHAI Based On Service Rendered On Deputation

The case before the Supreme Court involved an employee, Athipathi, who served on deputation with the National Highways Authority of India (NHAI) from 2008 to 2014. He sought promotion based on the service he rendered during his deputation tenure. 

The Supreme Court ruled that deputation service could be counted as regular service for promotion under government regulations,  emphasizing uninterrupted service as crucial for eligibility.

Athipathi, a government employee, repatriation was held as a break in service, disqualifying him from promotion. The court upheld NHAI’s decision to deny promotion, reversing the orders of CAT and the Madras High Court.
