SC Reserves Judgment on Transwoman's Employment Discrimination Plea

A transwoman teacher claims her employment was terminated in schools in Gujarat and Uttar Pradesh after her gender identity was revealed.

Alleged discrimination in employment based on gender identity, violating constitutional and statutory protections under Articles 21, 14, 15 and 19 of the Constitution.

The petitioner relies on NALSA v. Union of India (2014) which recognized transgender rights, and the Transgender Persons (Protection of Rights) Act, 2019, ensuring equal opportunities in education and employment.

The Supreme Court, hearing the matter since January 2023, has reserved its judgment, directed written submissions within two weeks, and sought responses from the Union, State Governments, and schools involved.
