Supreme Court Revokes Suspension of Kuldeep Sengar’s Sentence in Unnao Rape Case

The Supreme Court has set aside the Delhi High Court’s order suspending the life sentence of former BJP MLA Kuldeep Singh Sengar in the 2017 Unnao rape case.

A Bench comprising Chief Justice Surya Kant and Justice Joymalya Bagchi criticized the High Court’s "hyper-technical" interpretation of POCSO provisions, which questioned if an MLA qualified as a "public servant" in a dominant position.

Reaffirming that penal laws must prioritize child protection, the Apex Court ordered Sengar back to jail.

The High Court has been directed to decide Sengar’s pending appeal against his conviction within two months.
