Supreme Court: Anticipatory Bail is Not Allowed in NDPS Act Cases

The Supreme Court has denied anticipatory bail to an accused in a drug case under the NDPS Act, reaffirming that such relief is not permitted in matters involving commercial quantities.

A bench of Justices Pankaj Mithal and KV Viswanathan upheld the Punjab and Haryana High Court’s order, highlighting that the accused was named by a co-accused who had 60kg of poppy husk and 1.8 kg of opium and linked through call records and financial transactions.

Citing Section 37 of the NDPS Act, the Court advised the petitioner to surrender and seek regular bail, reiterating the need for strict scrutiny in serious drug-related offences.
