The Supreme Court issued notices to the Centre and all States/UTs in response to a petition by Nikhil Upadhyay challenging the constitutional validity of several provisions of the Waqf Act, 1995, as amended in 2025.
The petition alleges discrimination under Articles 14, 15, 21, 25, 26, and 27, arguing that only Muslims have a specific law for managing religious properties.
Challenged sections include 3(r), 4–8, 28, 29, 33, 36, 41, 52, 83, 85, 89, and 101.
The Court has tagged this plea with similar pending petitions and questioned the delay in challenging the 1995 Act.
