Supreme Court Refers Judicial Officer Eligibility for District Judge (Bar Quota) to Constitution Bench

The Supreme Court has referred to a Constitution Bench the issue of whether a judicial officer, who had already completed seven years as an advocate, can be appointed as a District Judge in a Bar quota vacancy.

The Court will also decide if eligibility is determined at application, appointment, or both stages, under Article 233(2) of the Constitution.

The case stems from a Kerala HC ruling that annulled a District Judge’s appointment since he was in judicial service when appointed, relying on the Dheeraj Mor judgment.

The decision could impact similar appointments nationwide. The matter, involving substantial legal questions, will be heard soon.
