
The Supreme Court has strongly criticised a High Court for modifying bail conditions of an accused while the original bail order was still under challenge before the apex court.
The Supreme Court termed this act as judicial impropriety and a violation of procedural norms, emphasising that lower courts must refrain from intervening in matters pending before the higher judiciary.
Resultantly, the Court set aside the High Court's order modifying the bail condition, and issued the notice to the accused seeking an explanation as to why her anticipatory bail should not be cancelled due to this concealment of facts.
The court further underscored the importance of maintaining judicial hierarchy and avoiding parallel proceedings that could lead to conflicting orders.
