SC slams MP HC for terminating six women judges

  • Case Name: Aditi Kumar Sharma v State Of Madhya Pradesh And Ors, W.P.(C) No. 233/2024
  • Judge(s): Justices B V Nagarathna and N Kotiswar Singh

The Supreme Court has taken suo motu notice of the Madhya Pradesh High Court’s termination of six women judges during probation, citing poor performance. Aditi Kumar Sharma, one of the judges, faced personal hardships, including a miscarriage. While four judges were reinstated, Sharma and Sarita Chaudhary were excluded.

The key issue is whether the termination violated Articles 14 and 21, disregarding personal challenges, maternity leave, and due process. Sharma alleged her termination ignored her flawless record and unfairly assessed her performance during maternity leave, violating her fundamental rights.

The Supreme Court, criticizing gender bias, issued notices and will review the terminations. The next hearing is on December 12.
