Supreme Court Summons Madhya Pradesh Law Secretary Over Delayed Appeals

  • Case Name: State of Madhya Pradesh vs Gokulchand
  • Judge(s): Justices JB Pardiwala and R Mahadevan
  • Advocate(s): : Additional Advocate General Nachiketa Joshi, Dep

The Supreme Court summoned the Madhya Pradesh Law Secretary to identify the authority approving appeals filed after excessive delays.

The State’s appeal was delayed by 177 days, challenging a High Court order that refused to condone a 656-day delay.

The court criticized the State’s repeated failure to justify long delays and noted its pattern of filing Special Leave Petitions with delays of 300-400 days.

It directed the Law Secretary to appear on February 14, 2025, with original files explaining the decision-making process, questioning why such delayed appeals are being pursued despite procedural lapses.
