SC Takes Up Suo Motu Case on Stay Orders' Impact on Trials

On December 4, 2024, the Supreme Court initiated a Suo motu case titled IN RE: Adverse Effect of Stay Orders Granted by Appellate Courts on the Pace of Trials to address delays in criminal trials caused by appellate court stay orders.

The issue was prolonged trial delays despite prior Supreme Court guidelines.

In the Senthil Balaji bail case, the Court criticized delays. A five-judge bench earlier ruled that stay orders don’t lapse after six months, overturning the 2018 Asian Resurfacing judgment.

The case will be heard on December 9, 2024, by a bench led by CJI Sanjiv Khanna.
