Supreme Court to Examine Whether 4% Disability Quota Applies Across All Categories or Only Open Merit

The Supreme Court will examine whether the 4% reservation for persons with disabilities under Section 34 of the Rights of Persons with Disabilities (PwD) Act, 2016 should apply horizontally across all vertical categories SC, ST, OBC, EWS, RBA, and Open or remain confined to the open category. 

The plea by Dawood Ahmad Bhat challenges the Jammu & Kashmir Public Service Commission’s (PSC) Civil Judge (Junior Division) recruitment, where two PwD candidates were selected only under open merit.

The J&K High Court upheld the PSC’s method, after which a bench of Justices P.S. Narasimha and A.S. Chandurkar issued notice.
