Supreme Court to Hear Pleas Challenging Law Dropping CJI from EC Selection Panel on Nov 11

The Supreme Court will hear on November 11, 2025, a batch of petitions challenging the constitutional validity of the Chief Election Commissioner and Other Election Commissioners Act, 2023.

The law replaced the Chief Justice of India with a Union Cabinet Minister nominated by the Prime Minister on the panel that appoints Election Commissioners.

Petitioners, including Congress leader Jaya Thakur and the Association for Democratic Reforms, contended that the change undermines the Election Commission’s independence and violates the principles of free and fair elections.

The matter was earlier deferred but is now listed for a detailed hearing.
