
The Supreme Court has directed the transfer of a hit-and-run case from Phagwara, Punjab, to the Court of the Chief Metropolitan Magistrate, Rohini Courts, Delhi, to ensure a fair trial.
The victim’s family had raised concerns of bias, given that the accused is a serving Judicial Magistrate in Punjab. While the officer did not oppose the transfer, he requested that the trial be moved to Noida instead, citing apprehensions of hostility in Delhi, a plea the Court declined to accept.
The Bench further allowed the petitioner to approach the Delhi court for any request seeking additional investigation.
