SC Upholds Karnataka HC's Ruling on Police Custody Under BNSS

The Supreme Court upheld the Karnataka High Court's decision, refusing to grant police custody beyond the 40-day limit under Section 187 of the Bharatiya Nagarik Suraksha Sanhita (BNSS). 

The High Court ruled that police custody in cases of offences punishable up to ten years is restricted to 15 days within the first 40 days of investigation.

The case involved an appeal challenging the Magistrate's refusal to grant custody beyond this period. Section 187 of BNSS aligns with Section 167(2) CrPC, allowing up to 90 days for serious offences, and 60 days for others.
