SC Upholds NIA's Authority to Investigate Linked Non-Scheduled Offences

  • Case Name: Ankush Vipan Kapoor v. National Investigation Agency, SLP(Crl) No. 2819/2024
  • Judge(s): Justice BV Nagarathna and Justice NK Singh

The case involves where accused was charged under the NDPS Act and Arms Act, with the NIA linking them to terrorism and hawala transactions under Sections 17 & 18 of UAPA, 1967

The SC addressed whether the NIA could investigate non-scheduled offenses under Section 8 of the NIA Act. The SC ruled that the NIA can investigate related crimes, even if they aren't listed as major offences, as long as the Central Government approves.

The court also agreed with canceling the bail, emphasizing the danger of drug trafficking, funding terrorism and the need for custody to investigate the international drug and money networks.
