SC Warns HP Govt For Acquiring Private Property Without Compensation

The Supreme Court warned the HP Govt. for acquiring land for the construction of road without compensation.

The Court emphazied that the right to property is no longer fundamental, but it remains a constitutional right under Article 300A.

The Court found the state's claim of oral consent is "unsustainable in law" and cited Vidya Devi v. State of Himachal Pradesh (2020) to reinforce that dispossessing a citizen's property without due process violates constitutional and human rights.
