The Delhi High Court held that mere allegations of ill-treatment against a person belonging to a Scheduled Caste are insufficient to attract provisions of the SC/ST (Prevention of Atrocities) Act.
The Court emphasized that a clear and specific intent to humiliate on the basis of caste is essential.
It clarified that the offence hinges not just on the act, but the caste-based motive behind it.
In the absence of a direct nexus between the conduct and caste identity, criminal prosecution under the Act cannot be sustained, leading to quashing of proceedings.
