
The Himachal Pradesh High Court examined the scope of Section 81 IPC, which protects acts done in good faith to avoid greater harm, while hearing a road accident case involving multiple deaths.
The accused argued that he swerved the vehicle to avoid hitting one person and therefore acted to prevent a greater harm.
However, the Court observed that the act resulted in more serious consequences and noted that the protection under Section 81 IPC depends on the facts and circumstances of each case.
Finding no grounds to interfere with the conviction, the Court rejected the defence raised by the accused.
