The Kerala High Court cautioned police against conducting unilateral investigations in sexual assault cases filed by women.
The case involved Noushad, a 57-year-old man, accused of sexually harassing a woman employee on December 20, 2024, under Section 75(1) of BNS.
Noushad submitted complaint reports filed well before the petitioner’s and provided audio recordings contradicting her claims.
After reviewing the evidence, the court granted him bail, directing him to cooperate with the investigation and instructed the police not to trust the woman's complaint blindly, and examine the evidence thoroughly.
