
The Supreme Court has reiterated that the responsibility to exclude the "creamy layer" of Scheduled Castes (SC) and Scheduled Tribes (ST) from receiving reservation benefits rests with the legislature and executive.
This comes in response to a petition aiming to prevent children of IAS and IPS officers from accessing such benefits in Madhya Pradesh.
Referencing its judgment from August 2024, the Supreme Court reinforced its stance that those who have already gained advantages and are capable of competing equally should not receive reservations.
Nonetheless, the court made it clear that this is a suggestion rather than a requirement, necessitating legislative action.
