The Rajasthan High Court upheld sexual harassment charges under Section 11(iii) of the POCSO Act against a man accused of showing adult videos to a minor girl.
While dropping stalking charges under IPC due to lack of evidence, the Court ruled that under Sections 11 and 30 of POCSO, sexual intent must be presumed once harassment is proven. The burden then shifts to the accused to disprove intent.
The Court also invoked Section 354A(iii) IPC, adding charges for showing pornography against a minor’s will, aligning the act with statutory provisions on sexual harassment.
