Singapore Court Sets Aside ₹80 Cr Award Over Copy-Paste by Retired Indian Judges in Arbitration

The Singapore International Commercial Court has annulled a June 2024 ICC arbitration award of ₹80.29 crore, citing extensive verbatim copying from a prior decision without independent analysis.

The tribunal, comprising retired Indian judges, replicated 157 of 176 substantive paragraphs from an earlier CTP-13 award, even referencing contractual clauses absent in the current CTP-11 agreement.

Additionally, the tribunal erroneously applied Indian law instead of Singapore law for interest calculations.

Judge Roger Giles criticized the tribunal's approach as demonstrating a "closed mind," violating principles of natural justice. The court has directed the parties to agree on the costs of the proceedings.
