The Supreme Court declared that 10 Tamil Nadu Bills re-passed by the State Assembly after the Governor initially withheld assent were deemed to have received assent on November 18, 2023, the date of re-presentation.
The Court stated that the Governor's long delay in taking action and his decision to send the Bills to the President, which was not legally justified, has no legal value and is invalid in the eyes of the law.
Citing constitutional responsibility and federal principles, the bench affirmed that the Governor’s delay cannot stall the legislative process.
The 10 Acts are valid and stand notified without the Governor's signature.
