Stay on the registration of Jack Daniel’s trademark: Delhi HC

In this case, both the entities involved in the use of same trademark in different sectors. Jack Daniels Properties Inc. approached the Delhi HC seeking cancellation of the trademark registered by Mangalam Krupa, a pharmaceutical company, under Section 57 of Trade Marks Act, 1999.

The petitioner argued that using its trademark in the pharma sector could mislead the consumers and would harm the brand's reputation.

The Delhi HC stayed the registration of Mangalam Krupa’s trademark as it would violate Section 9(2)(a) and Section 11 of the TMA, 1999.  The next hearing is scheduled on March 26, 2025.
