The Supreme Court acquitted a death-row convict due to “faulty investigation,” notably improper DNA evidence handling in a 2021 murder-rape case.
The bench held that key lapses in the absence of a chain of custody, delayed sample dispatch, and poor documentation weakened the prosecution’s case.
Recognising systemic issues, the court introduced nationwide binding protocols for DNA collection and preservation, including strict timelines, proper labelling, signature requirements, and authorised resealing.
The court mandated that all states’ DGPs implement standardised chain-of-custody registers and train investigating officers accordingly. (Devakar V State of Tamil Nadu)
