Supreme Court Affirms Scrapping of DND Flyway Toll

The NOIDA Toll Bridge Company Limited (NTBCL) collected toll fees for the DND Flyway until the Allahabad High Court struck it down in 2016 after a PIL challenged its legality, citing the lack of competitive bidding and NTBCL’s unjust enrichment. NTBCL subsequently appealed the decision to the Supreme Court.

The case focused on the legality of NTBCL's toll collection and judicial review of its concession agreement with NOIDA. The public claimed the toll defrauded commuters and violated Article 14 due to the absence of a tender process, while NTBCL defended its actions under the agreement.

The Supreme Court upheld the High Court’s decision, declaring the toll collection illegal and fraudulent, and dismissed NTBCL’s appeal.
