Supreme Court Allows Patent Mapping in Cancer Drug Dispute Between Squibb and Zydus

The Supreme Court allowed ER Squibb to carry out a “product-to-claim mapping” exercise in its patent dispute with Zydus over a cancer drug.

It directed Zydus to provide a sample of its product within 24 hours so that Squibb can compare the product’s features with the claims in its patent.

This mapping will help determine whether Zydus’ drug falls within the scope of Squibb’s patent. The Court also said Squibb may approach the Division Bench of the Delhi High Court for interim relief after the mapping is done.

The Supreme Court disposed of the appeal with these directions.
