Supreme Court Applauds Out-of-Court Settlement in 'Ghadi' Trademark Dispute

The Supreme Court commended the out-of-court settlement in a trademark dispute between RSPL Ltd., owner of the well-known ‘Ghadi’ brand, and Vedanta Tea Agro Industries.

RSPL initiated legal proceedings in 2016 under the Trademarks Act, alleging that Vedanta was using a similar ‘clock’ logo on tea packaging, infringing its registered trademark.

A court-ordered search led to criminal complaints, including wrongful restraint allegations.

The Supreme Court, while staying proceedings, encouraged settlement. The parties signed an MoU affirming RSPL's exclusive rights over 'Ghadi'.

The Court invoked Article 142 to quash all criminal cases and decree the civil suit, emphasizing amicable resolutions.
