Supreme Court Clarifies : Same FIR Cases Need Not Always Go to Same Judge

The Supreme Court clarified the order produced in the case of  Rajpal Vs. State of Rajasthan 2023, which ruled all bail applications arising out of the same FIR needs to be produced before the same Judge bench. 

However, the Court clarified that the rule requiring bail applications from the same FIR to be listed before the same judge would not apply if the previous judge is no longer handling bail matters due to a roster change.

The Registrar is directed to forward the copy of the order to all the High Courts.
